Important: FireWarning is an informational tool and is not a substitute for official emergency alerts, evacuation orders, or guidance from local emergency management authorities. Always follow instructions from official sources during a wildfire emergency.
The Gist
These Terms of Service ("Terms") describe our commitments to you, and your rights and responsibilities when using our services. Please read them carefully and reach out to us if you have any questions. If you don't agree to these Terms, don't use our services.
Terms of Service
These Terms govern your access to and use of the software, applications, and other products and services we provide through or for FireWarning on iOS ("Services"). By accessing or using any part of our Services, you agree to be bound by all of the Terms and all other operating rules, policies, and procedures that we may publish via the Services from time to time (collectively, the "Agreement").
1. Who's Who
"You" means any individual or entity using our Services. If you use our Services on behalf of another person or entity, you represent and warrant that you're authorized to accept the Agreement on that person's or entity's behalf.
2. Your Use of Our Services
FireWarning is provided as an informational service. Fire data is sourced from NASA FIRMS, NIFC/WFIGS, and the National Weather Service. While we make every effort to display this data accurately and promptly, we cannot guarantee the completeness, accuracy, or timeliness of fire detection data. Satellite fire detections may be delayed by cloud cover, satellite overpass timing, or data processing latency.
You agree to use FireWarning as one tool among many — not as your sole source of emergency information. Always monitor official emergency management channels, local news, and evacuation orders from authorities.
3. Minimum Age Requirements
Our Services are not directed to children. You're not allowed to access or use our Services if you're under the age of 13 (or 16 in Europe). You may use our Services only if you can legally form a binding contract with us.
4. Fees, Payment, and Renewal
Fees for Paid Services. Some of our Services are offered for a fee. By using a Paid Service, you agree to pay the specified fees. For recurring fees (subscriptions), your subscription begins on your purchase date and renews at the selected interval until you cancel.
Taxes. All fees do not include applicable taxes. You're responsible for paying all applicable taxes relating to your use of our Services.
Payment. You must provide accurate and up-to-date payment information. If your payment fails, we may cancel your access to Paid Services without notice.
Refunds. We do not handle refunds for apps purchased through the Apple App Store. Please contact Apple to request a refund.
5. Feedback
We love hearing from you and are always looking to improve our Services. When you share comments, ideas, or feedback with us, you agree that we're free to use them without any restriction or compensation to you.
6. General Representation and Warranty
You represent and warrant that your use of our Services will be in strict accordance with the Agreement, will comply with all applicable laws and regulations, and will not be for any unlawful purposes.
7. Intellectual Property
The Agreement doesn't transfer any Blue Ridge Software Development or third-party intellectual property to you. All right, title, and interest in and to FireWarning remains solely with Blue Ridge Software Development. Fire data from NASA FIRMS, NIFC/WFIGS, and the NWS is public domain and provided under their respective terms of use.
8. Changes
We may modify the Terms from time to time to reflect changes to our Services or for legal or regulatory reasons. If we make material changes, we will notify you by updating the effective date above. Continued use of our Services after changes constitutes acceptance of the updated Terms.
9. Termination
We may terminate your access to all or any part of our Services at any time, with or without cause, effective immediately. You can stop using our Services at any time.
10. Disclaimers
Our Services are provided "as is." Blue Ridge Software Development hereby disclaims all warranties of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.
FireWarning does not guarantee that all fires will be detected or that alerts will be delivered in time to allow for safe evacuation. Wildfire behavior is inherently unpredictable. Do not rely solely on FireWarning for life-safety decisions.
11. Jurisdiction and Applicable Law
The Agreement and any access to or use of our Services will be governed by the laws of the state of South Carolina, U.S.A., excluding its conflict of law provisions. The proper venue for any disputes will be the state and federal courts located in Greenville County, South Carolina, U.S.A.
12. Limitation of Liability
In no event will Blue Ridge Software Development, or its suppliers, partners, or licensors, be liable for any special, incidental, or consequential damages; for interruption of use or loss or corruption of data; or for any amounts that exceed $50 or the fees paid by you to Blue Ridge Software Development during the twelve (12) month period prior to the cause of action, whichever is greater.
13. Indemnification
You agree to indemnify and hold harmless Blue Ridge Software Development, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all losses, liabilities, demands, damages, costs, claims, and expenses arising out of or related to your use of our Services.
14. Miscellaneous
The Agreement constitutes the entire agreement between Blue Ridge Software Development and you concerning our Services. If any part of the Agreement is unlawful or unenforceable, that part is severable and does not affect the validity of the rest of the Agreement.
